What are the benefits of getting your documents notarized?

Have you wondered why it might be a good idea to get your documents notarized, or why some documents must be notarized? In this blog post, we explain the benefits of having your documents witnessed and signed by a notary public.

What is a notary?

A notary public is a licensed individuals who can verify identities, witnessand attest to the execution (signing) of documents, verify that copies are true and authentic, as well as commissioning affidavits and oaths. In Ontario, notaries are appointed and  regulated by the Ministry of the Attorney General.

Notaries are like “super witnesses.” A document that is witnessed and signed by a notary is considered to be highly reliable and credible. In other words, a document that is notarized is more likely to be accepted as real than a document that isn’t.

Notaries play an important role in ensuring that documents are executed properly and that the people who have signed them are who they say they are. By attesting to the execution of documents and administering oaths, notaries public help prevent fraud and provide peace of mind to those involved in transactions.

Do some documents require notarization?

Yes, some documents must be notarized, including certified true copies, affidavits and statutory declarations. When a notary signs these documents, it guarantees that the person who signed the document is who they say they are and it is their actual signature on the document.

My document doesn’t need a notary - but should I get it notarized anyway?

Some documents, like Ontario powers of attorney, separation agreements and contracts, do not require notarization to be considered legally valid.

However, even if your document does not need to be notarized, you may still want to have your documents witnessed, signed and sealed by a notary to provide additional assurance that the document was properly signed and is authentic.

Notaries provide peace of mind by attesting to the execution of documents and administering oaths. This means that you can be sure that the documents you sign are valid and that the people who have signed them are who they say they are.
