Affidavits of Vehicle Ownership
Have you purchased a used vehicle in Ontario but didn’t receive a bill of sale or ownership, or maybe you lost it? If so, you may need to get an affidavit of ownership to register your used vehicle with Service of Ontario! This blog post explains how you can get an affidavit of ownership for your used vehicle if you don’t have a bill of sale or other proof of ownership.
What is an affidavit of ownership?
An affidavit of ownership is a sworn statement that sets out when and from whom you purchased the used vehicle and why you can’t provide a bill of sale or proof of ownership. Affidavits of used vehicle ownership must be signed in front of a notary public or commissioner for taking affidavits.
The affidavit should include:
Your name and address
The vehicle type and VIN number
The seller’s name
The date you purchased it
The purchase price
Why you don’t have a bill of sale:
If the seller did not provide one, you should explain what efforts you made to get a bill of sale and why you were not successful in getting one
If the bill of sale was lost or destroyed, you should explain how this happened
How do I know if I need an affidavit of ownership?
In Ontario, you must register a used vehicle with Service Ontario within six days of purchase.
To register the vehicle, you need to bring the following to a Service Ontario centre:
proof of insurance
your Ontario Driver’s Licence
used vehicle information package (UVIP)
bill of Sale (you can use the bottom of the used vehicle information package, as there is a section specifically for this)
Safety Standards Certificate (SSC), if applicable
owner’s permit with the completed Application for Transfer portion on the back
odometer reading information
If you do not have a bill of sale, you can provide Service Ontario with a notarized affidavit of ownership that explains when you purchased the vehicle and why you can’t provide a bill of sale.
What if I don’t have the seller’s information?
If you don’t have the seller’s name or details, that’s okay! You can order a Used Vehicle Information Package from Service Ontario. The Used Vehicle Information Package includes the information of all previous owners.
